1. Acceptance of Terms

By accessing bigstateroofing.com or hiring Big State Roofing & Restoration LLC for any project, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site or our services.

2. Who We Are

3. Scope of Services

We provide roof inspections, repairs, replacements, gutters, siding, fencing, attic insulation and storm-damage restoration. Specific deliverables, materials and timelines will be set out in your written Proposal or Work Order (“Contract”). If these Terms conflict with a signed Contract, the Contract controls.

4. Quotes, Deposits & Payment

· Quotes are valid for 30 days unless otherwise stated.

· Deposits—typically 50 %—are due at Contract signing; the balance is due upon Substantial Completion or according to milestone schedule in your Contract.

· Late payments accrue interest at 1.5 % per month (18 % APR) or the maximum allowed by law. We may stop work or withhold warranties until paid in full.

· You are responsible for all collection costs—including reasonable attorneys’ fees—incurred to recover unpaid sums.

5. Change Orders

Any change to scope, materials or scheduling must be documented in a signed Change Order and may affect price and completion date.

6. Scheduling & Site Access

You agree to provide clear access to the work area, active utilities and restroom facilities (or allow us to provide portable restroom service for a fee). Weather, material availability or unforeseen structural issues may cause schedule adjustments.

7. Material & Workmanship Warranty

· We pass through all manufacturer shingle warranties (typically 20–50 years).

· Big State provides a 5-year workmanship warranty against leaks caused by installation errors.

· Warranty is void if you (or another contractor) alter the roof, fail to maintain it, or fail to pay in full.

8. Disclaimers & Limitation of Liability

· EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

· We are not liable for consequential, incidental or special damages (lost profits, interior water damage after substantial completion, etc.) beyond the cost you actually paid us.

· Some states do not allow all exclusions; if so, exclusions apply only to the extent permitted.

9. Insurance & Licensing

We carry general liability and workers’ compensation coverage; certificates available upon request. Licenses and registrations are on file where required.

10. Customer Responsibilities

· Obtain HOA approvals, permits (unless our Contract states we will), and property-line verifications.

· Remove fragile items from walls or ceilings; vibration may cause damage.

· Keep children & pets away from work zone.

11. Intellectual Property (Website)

All text, graphics and logos on this Site are Big State’s property or used under license and may not be reproduced without written consent.

External links are provided for convenience. We are not responsible for their content or privacy practices.

13. Governing Law & Dispute Resolution

These Terms are governed by Texas law. Any dispute arising from the Site or services will first go to good-faith mediation in Walker County, TX; if unresolved, it will be submitted to binding arbitration under the Construction Industry Rules of the American Arbitration Association. Judgment may be entered in any court of competent jurisdiction.

14. Changes to Terms

We may update these Terms at any time. Material changes will be announced on the Site; continued use after posting constitutes acceptance.
